1. Service Description

BibiVini provides a software-as-a-service platform that enables wineries to create mobile-friendly wine tech sheets accessible via QR codes. Our service includes QR code generation, wine information management, custom branding, and scan analytics.

2. Account Registration

To use BibiVini, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3. Subscription and Billing

BibiVini offers monthly subscription plans with different features and wine limits. By subscribing, you agree to pay the applicable fees.

• Core Plan: $40/month — Up to 5 wines, basic features
• Premium Plan: $60/month — Unlimited wines, advanced features including custom branding
• Drone Footage: $125 per hour — optional aerial footage add-on available with any plan (North Bay vineyards only)

If you are not satisfied with BibiVini, you may request a full refund within 30 days of your initial subscription payment. To request a refund, contact us at info@bibivini.com. Refunds apply only to the first payment and are not available for subsequent renewal charges. Drone footage services are non-refundable once scheduled.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

4. User Obligations

You agree to:

• Provide accurate information about your wines and winery
• Use the service only for lawful purposes related to wine marketing
• Not upload content that infringes on intellectual property rights
• Not attempt to reverse engineer, modify, or create derivative works of our service
• Comply with all applicable laws, including those related to alcohol marketing

5. Intellectual Property

You retain ownership of all content you upload to BibiVini, including wine descriptions, images, and branding assets. By uploading content, you grant BibiVini a license to display and distribute that content as necessary to provide our services.

BibiVini and its logo are trademarks of BibiVini. You may not use our trademarks without prior written permission.

6. Limitation of Liability

BibiVini is provided “as is” without warranties of any kind. To the maximum extent permitted by law, BibiVini shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Termination

You may terminate your account at any time by deleting it from your account settings. We may suspend or terminate your account if you violate these terms or for any other reason with reasonable notice.

Upon termination, your access to the service will cease and your data may be deleted in accordance with our Privacy Policy.

8. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through the service. Your continued use of BibiVini after changes take effect constitutes acceptance of the modified terms.

9. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
